Those recordings dont necessarily present a security threat in and of themselves, Hunt said, but parents should certainly be aware of whats out there. And CloudPet users should be sure to change their passwords, especially if theyve reused them for other internet accounts.

Many of the same problems are present we have in other data breaches: email addresses could be used for spam or phishing, and reused passwords could be used to exploit other accounts, added Hunt. Theres little practical value for childrens voice recordings, but of course as parents wed feel very uneasy knowing that other people could have them.

The main takeaway?Think twice before you welcome any internet-connected device into your home, particularly ones that children may interact with on a regular basis.

The bigger picture here is to think very carefully before giving a child a connected device like this, Hunt concluded. By all means, get them involved early with computers and responsible internet use, but in my view connected toys like this pose too great a risk.

Hackers havent just accessed the data, according to Hunt. He says theres clear evidence cybercriminals have held the database for ransom, at least twice, demanding money from the company in exchange for the datas safe return.

The database was no longer publicly accessible as of Jan. 13, Hunt said, but anyone who obtained the data while it was live could still use it for nefarious purposes, including accessing a victims account.

This service and the files really need to be taken offline ASAP until everything can be properly secured, Hunt said.

The Supreme Court dismissed the suit last year.

States, they can pass the laws they choose, he added. I would just say it does remain a violation of federal law to distribute marijuana throughout any place in the United States, whether a state legalizes it or not.

Spicer raised concerns among advocates for marijuana policy reform when he said states that have legalized recreational marijuana will see greater enforcement of federal laws surrounding the plant. Spicer explained that President Donald Trump sees the legalization of medical and recreational marijuana as two separate issues, and while the president understands the importance of the drugs availability for medical purposes, Spicer said recreational use of the drug is something the Department of Justice will be looking into.

Spicers statements marked a shift from Trumps own remarks during his campaign, when he repeatedly said he would respect states rights on the issue.

Marijuana remains illegal under the federal Controlled Substances Act, despite statesefforts to scale back on criminalizing the plant over the past few years. Legal recreational marijuana has been approved in eight states and Washington, D.C., which continues to ban sales, unlike the state programs. A total of 28 states have legalized marijuana for medical purposes.

Former President Barack Obamas Justice Department allowed states to forge their own way on marijuana policy with guidance urging federal prosecutors to refrain from targeting state-legal marijuana operations. But this guidance is not law and can be reversed by the Trump administration.Sessions said they were looking at the memos that set out enforcement priorities, which he said had some points of value.

Trumps selection of Sessions to head the DOJ alarmed drug policy reformers who view the former Alabama senator as a drug war dinosaur. Thats because Sessions has long held retrograde views on marijuana and the disastrous war on drugs. During a Senate hearing last year, Sessions spoke out against weed and urged the federal government to send the message to the public that good people dont smoke marijuana. He went on to criticize Obama for not speaking out more forcefully against the drug, saying that we need grown-ups in Washington to say marijuana is not the kind of thing that ought to be legalized. In separate comments last year, Sessions also called the legalization of marijuana a mistake.

And while Sessions didnt appear to suggest there would be radical changes to federal enforcement of marijuana laws during his confirmation hearings last month, he only offeredvague answers about how he might approach the drug and left the door open for increased federal interference with states.

Drug policy reformers have raised concerns that Sessions could use the FBI to crack down on marijuana operations nationwide, or direct the Drug Enforcement Administration to enforce federal prohibition outside of the jurisdiction of the U.S. Court of Appeals for the 9th Circuit. The court ruled in August that a federal rider blocks federal officials from prosecuting state-legal marijuana operators and patients. But that rider must be re-approved annually, and if its allowed to expire, Sessions could then order the DEA to enforce federal law nationally. He could also sue the various state governments that have set up regulatory schemes.

Marijuana is the most commonly used illicit substance in the United States, and the trend of states bucking prohibition in favor of legal regulation of the plant reflects a broad cultural shift toward greater acceptance of marijuana. National support for the legalization of the drug has risen dramatically in recent years, recently reaching historic highs in multiple polls. And states like Colorado, the first to establish a regulated adult-use marijuana marketplace, have seen successes that have debunked some lawmakers and law enforcers predictions that such policies would result in disaster.

A survey from Quinnipiac University released last week found a strong majority of American voters 71 percent want the federal government to respect state marijuana laws. In that survey, majorities of Republicans, Democrats, independents and every age group polled agreed the feds should not enforce prohibitionist laws on states that have legalized marijuana.

Marijuana policy reform advocates said Sessions comments actually show the need for further reform.

By talking about marijuana and violence, the attorney general is inadvertently articulating the strongest argument that exists for legalization, which is that it allows regulated markets in a way that prohibition does not, said Tom Angell, chairman of drug policy reform group Marijuana Majority. The only connection between marijuana and violence is the one that exists when illegal sellers battle it out for profits in the black market.

The 18-year-old all-state cheerleader was just picking up her little brother from football practice when she got into a fender bender in the parking lot a minor accident that is almost a rite of passage for thousands of teenagers every year. But this crash was different, because this car had a defective Takata airbag. It exploded violently, sending piercing metal shrapnel everywhere. One of those shards sliced her neck, and she was dead within minutes.

Her name is Ashley Parham, and she was the first fatality of the defective Takata airbag. When she was killed, Ashley had just graduated from high school. She had dreamed of being a teacher.

If the story of her death is gruesome to read, think of how painful it was for her family to experience. And then think of how they felt when they learned that executives at the company that manufactured the airbag in their car the airbag that killed their daughter knew about the defect years earlier.

Sometimes fraud can seem to be a technical violation, but this fraud concealed product defects that killed people.

Ashley is one of eleven people who have died as a result of Takatas defective product. Nearly two hundred others have been injured wounding limbs, suffering terrible facial lacerations, or losing their sight.

Eighteen months ago, we called on Takata to establish a victims compensation fund to support those injured or killed by the companys dangerous and defective product.Takatas response? Thanks, but no thanks.

That response wasnt acceptable to us, and it wasnt acceptable to the Department of Justice prosecutors who took Takata to court and made sure that the settlement Takata agreed to last month included in addition to a guilty plea and $25 million criminal penalty $975 million in restitution for victims.

In fact, DOJ is pursuing criminal charges against three executives for allegedly fabricating test data and knowingly placing profits before peoples lives.

So here we are, more than a year and a half later, and Takata has agreed through a plea agreement to create a victims compensation fund. Takata and Department of Justice attorneys are now just a day away from finalizing the exact terms of a restitution order that requires the company write a $975 million check to victims for their criminal misbehavior.

When we first called on Takata to establish a compensation fund for victims, we knew of eight deaths and more than 100 injuries linked to defective Takata airbags. Since then, there have been three more confirmed deaths and the number injured is now near 200.

Knowing that Takatas explosive airbags have resulted in 11 fatalities and nearly 200 injuries, you might guess that most of that money will be directed to the families of victims. Families whose fathers and mothers or sons and daughters took the car out for an errand, school, or work, and came back grievously injured, or never came home at all. Unfortunately, youd be wrong.

Instead, a mere $125 million has been designated for individuals whose lives have been irreparably harmed by Takatas defective product, and its not clear from the terms of the plea agreement if this amount will even cover families of victims killed like Ashley Parhams.

Let us be clear: there is no amount of money that can replace what these families have lost. There is no definitive metric to determine how to value the loss of a limb or the loss of a life. But this amount does not even begin to make a dent especially when the number injured and killed is almost certain to rise.

The amount set aside for actual victims is especially paltry when compared to the $850 million fund for so-called auto manufacturer victims for their airbag recall and replacement costs as a result of Takatas fraud. Some of these manufacturers may have even been complicit in this tragedy by their aggressive pursuit of cheaper airbags, disregard of safety specifications and testing, and failure to alert safety regulators of troubling patterns. At best, they failed to protect their customers and serve as any kind of check on Takatas rampant wrongdoing.

And is their financial hit really seven times greater than the pain and suffering of human causalities?

No.

Before the $975 million restitution order is finalized on Monday, we urge the prosecutors to reconsider the allocation of this funding and shift a great percentage of the settlement to the victims compensation fund, and ensure that it accounts for compensation for families of individuals killed by the Takata airbag defect. The current amount is simply insufficient.

Why American Democracy Will Hold Strong

After five weeks of steadily pummeling, American democracy is holding because its institutions are stronger than Donald Trump. Lets begin with the press.

As John McCain reminded us, dictators get started by suppressing free press and Donald Trump is no exception. Trump and his press spokesman, Sean Spicer, will not be satisfied until there is a totally sycophantic press, accepting Trumps twisted view of the truth, and adoringly reflecting it back to the great leader and his people. Kind of like the free press in Putins Russia.

But thats not going to happen. The press has never been more determined to hold its ground.

Certainly, press solidarity behind the First Amendment is not all that it should be.

In last weeks schoolyard game of banning from a White House briefing media with the temerity to expose Trumps lies, propaganda organs like Fox News and the Washington Times were all too pleased to play Sean Spicers petty game. Shamefully, so were ABC and NBC, whose correspondents did not walk out when the New York Times, the Washington Post, CNN, and other mainstream media were banished.

But maybe this charade is a blessing in disguise. For one thing, news organs will have to decide whether they are part of White House propaganda machine, or genuinely independent media. The ones that merely parrot Trumps lies will start looking very foolish.

For another, White House press briefings are vastly overrated. Its no accident that Bob Woodward and Carl Bernstein were on the Metro staff of the Washington Post, and did not cover the Nixon White House. They went after the real story where they found it, and press aide Ron Zieglers pressroom was the last place to look.

I had a White House press pass in that era, and I seldom used it. I can tell you that precious little news emerged from Nixon press conferences or briefings.

Fencing matches between reporters and Spicer are a weird form of entertainment, but not a venue from which truth will emerge. Besides, entertainment is Trumps genre, not that of a free press.

Theres a good case that the serious press should not allow itself to be props in Spicers petty games. They should demand equal treatment, but if he continues to play favorites, the hell with him. Indeed, if the Times, the Post, and other serious news organs are banished from the White House, they will have more time and resources to ferret out the truth.

Bullies usually turn out to be cowards. Spicer is hiding from the serious press because he cant face the truth. Likewise Trumps own refusal to follow custom and attend the White House Correspondents annual dinner. Hed be roasted alive.

Each day that Spicer stage-manages a phony press conference, the serious media should publish lists of questions that demand answers. If Spicer ducks them, hes that much more of a coward, because he and his boss cant face the truth.

The press is one of several firebreaks in an era when the President of the United States wants to govern as a dictator. And the press is not alone. Indeed, some of the firebreaks, institutions usually considered conservative, are already surprising Trump.

One is the courts. Even with the eventual confirmation of Trumps Supreme Court nominee, Neil Gorsuch, the courts will take a dim view of efforts by Trump to defy court orders. There is a higher loyalty to the independence of the judiciary. As opportunistic as many conservative judges are, an open attempt to place the president above the law would be struck down.

Another is the military. The military tends to be conservative in the best sense of the word. When zealous civilians (Cheney, Rumsfeld, George W. Bush, LBJ, Richard Nixon et.al.) send American forces on fools errands based on grandiose lies, it is the military that pays the price. And the generals know that.

It is strange for people with no love of militarism to admit that the security of American democracynot just in the sense of the national defense but of democracy itselfis now in the hands of three retired Marine Corps generals: the defense secretary James Mattis, the national security adviser H.R. McMaster and John Kelly, the secretary of homeland security.

These are serious men, with the patriotism and self-respect to tell the president when he is blowing smoke. He cant fire them all.

As Patrick Granfield wrote in a thoughtful piece for Politico:

A fundamental shift in civil-military relations is taking hold. Rather than civilian leaders checking military power, it is now military leaders who represent one of the strongest checks against the overreach of a civilian executive.

A fourth firebreak is at least part of corporate America. The nations most innovative companies have little patience for Trumps war on immigrants, and are willing to say so. (Other corporations, alas, are following a venerable tradition of getting in bed with fascism if it serves their bottom lines.)

Yet another firebreak is American federalism in two senses. Some blue states and cities can demonstrate policies that are the opposite of Trumpism. These policies are vulnerable, however, because most waivers that allow states to have policies at odds with those of the national government (such as higher minimum wages or tougher clean air standards) are merely statutory, not constitutional. And law can be changed.

But a stronger federal firebreak is the power of state attorneys general, who are beyond the reach of the Trump administration. New York Attorney General Eric Schneiderman is said to be pursuing major investigations of Trump corruption under state law. Among other findings, these investigations could force the release of Trumps tax records.

The press, by its nature, is an insurgent institution. It has always battled privilege and deception. But its a little strange for progressives to be cheering for other institutions that only yesterday were seen as citadels of conservatism: the military, the courts and states rights. Yet these are not just instruments of rightwing policies they are conservative in a deeper sense, one that is especially needed now.

One conservative institution, however, is missing from this list the Republican Party. To an appalling degree, Republicans have been willing to let Trump govern as a would-be dictator, as long as it serves their policy and partisan goals. If John McCain can shame a few more Republicans into remembering true conservative principles, it will drastically shorten this terrible time for America.
